Terms of use
This agreement governs use of Smekalka (smekalka.by, смекалка.бел, and app.smekalka.by) by individuals and business representatives. The смекалка.бел domain redirects to smekalka.by. Please read the sections below before registering or paying for a plan.

- Website — pages on the smekalka.by domain and the смекалка.бел domain (redirecting to smekalka.by), including marketing content, pricing, blog, and contact form.
- Application — the app.smekalka.by service and Smekalka native mobile apps, available after registration or in demo mode.
- Service — the Website and Application together, including expense tracking, material planners, projects, contacts, tasks, and related features.
- User — a capable individual or business representative who accesses and/or uses the Service.
- Administration — ИП Аль-Хатиб А. Ф., registered under the laws of the Republic of Belarus (UNP 692111656, address: 222666 Ул. Сологуба, 20, Столбцы, РБ), owner of the domains and operator of the Service.
- Account — the User's account in the Application, created with email and password or supported OAuth providers.
- Plan (Subscription) — a paid or free access tier described on the Pricing page.
This User Agreement (the “Agreement”) is a public offer to an indefinite circle of persons and governs relations between the Administration and the User when using the Service.
Acceptance of the offer under Article 408(3) of the Civil Code of the Republic of Belarus includes any use of the Service, including opening a page, registering, using demo mode, or paying for a plan.
By using the Service you confirm that you have read this Agreement, the Privacy Policy, and the Cookies policy. When registering or submitting forms you consent to personal data processing as described therein and under Belarus law.
If you do not agree, you must stop using the Service immediately and delete your account.
The Administration grants the User a non-exclusive license to use the Service software and features within the selected plan.
The Service is intended for personal and business planning of renovation and construction: expense tracking, material calculations (tiling, laminate, landscaping, and other modules), projects, contacts, and tasks.
The Administration is not a construction, design, or contracting company and does not perform on-site construction, installation, design, or consulting services. Reference content and specialist listings are informational.
The free plan and printable report allowance are for personal non-commercial use. Commercial use of B2B features (specialist directory, promotional tools, and other professional features) is allowed only under the applicable plan and Service rules.
Material planners produce bills of materials and layouts based on User input. Results are advisory and do not replace project documentation, contractor estimates, or on-site professional work.
The User is responsible for accurate measurements, material choices, compliance with building norms, and on-site decisions. The Administration does not guarantee that calculations match actual material use.
Demo mode is for familiarization only. Demo data may be deleted on a schedule without obligation to retain or restore it.
The Administration may change features, pricing, and module availability with notice on the Website or by email.
Exclusive rights to the Service, including code, databases, design, text, graphics, and branding, belong to the Administration or its licensors.
The User may not copy, decompile, resell access, scrape databases, overload infrastructure with automated requests, or use Service materials outside this Agreement without written consent.
The Service is provided “as is”. The Administration does not guarantee uninterrupted availability and may restrict or terminate access for violations.
Provide accurate registration data, keep your password confidential, and do not share account access. Actions through your account are deemed yours unless proven otherwise.
Sign-in via supported OAuth providers (Google, Apple, Yandex) is subject to their terms as well.
Illegal content, unauthorized access attempts, interference with the Service, spam, and unlawful use are prohibited.
Paid plans (Basic, Plus, Business) are described on Pricing. Subscription payment is made in Belarusian rubles (BYN) via bePaid on a secure checkout page.
Card payment data is processed by bePaid under PCI DSS and the provider's policies. The Administration does not store full card details.
Detailed payment, renewal, and refund terms are in Payment and refunds, which forms part of this Agreement.
Personal data is processed under the Privacy Policy and the Republic of Belarus Law No. 99-Z of 07.05.2021 “On personal data protection”.
By registering, contacting us, or paying for a plan you confirm that you have read those documents and consent to processing for the stated purposes.
The Administration is not liable for contractors' actions, retail material prices, losses from input errors or incorrect measurements, or decisions based solely on Application calculations.
Use of the Service is at the User's risk. Maximum liability is limited to fees paid for paid services in the last 12 months, unless mandatory Belarus law provides otherwise.
This Agreement remains in effect for as long as the User uses the Service.
The Administration may amend the Agreement by publishing a new version at https://smekalka.by/terms-of-use. The current version is binding from publication unless stated otherwise.
